In Illinois, every resident is required to have a photo ID or driver's license. In the past, you couldn't get a driver's license if you do not have social security. Then in 2005, documented immigrants with visas and no Social Security Numbers were allowed to obtain Temporary Visitor Driver's Licenses (TVDL). But in 2013, TVDLs became available to other motorists who cannot get a Social Security Number and do not have lawful immigration status.
However, individuals seeking a TVDL could be subject to suspension or criminal prosecution, as well as fines, if they have ever obtained a driver's license using false information or had a DUI. At Wierenga | Chiapelli, we are committed to protecting your rights and helping you obtain the most favorable outcome possible. Do not hesitate to get legal counsel from our Chicago criminal defense lawyer.
What Do Applicants Need to Do to Get a TVDL?
To qualify for a TVDL, an undocumented immigrant must:
- Have a valid, unexpired passport or consular ID
- Provide documents which demonstrate that you live in Illinois and has lived in the state for at least one year
- Pass all applicable vision, written, and road tests
- Show proof of insurance of the vehicle used in the road test
- Pay a $30 fee

Many undocumented immigrants fear that if they provide the Secretary of State with documents necessary for the TVDL, it could be used against them. But the Illinois Secretary of State's office states that personal information submitted by undocumented immigrants will not be used against them.
At Wierenga | Chiapelli, we can review your case and determine all of your available legal options if you have a previous record with law enforcement or have a previous DUI. We understand what it takes to help you obtain the TVDL, so let us help you today.
