Illinois & Wrongful Death Claims
In the state of Illinois, only certain relatives of the deceased may file a wrongful death claim. The person filing the claim must be able to claim one of the following relationships to the deceased:
- Spouse of the deceased
- Parent of a minor child who is deceased
- Adult child of the deceased
Even if you have a rightful claim, remember that there are other rules that apply to wrongful death lawsuits. In Illinois, the statute of limitations indicates that the lawsuit must be filed within 1 year of the deceased person's passing. However, in certain cases, the limit may be 2 years. To find out if you may file a claim, speak with our attorneys about your case immediately.
