What penalties am I facing for underage DUI?

As mentioned, Illinois has very strict laws against underage DUI, which means the penalties that follow are often severe. The consequences you face will depend heavily on your BAC at the time of arrest.

For example, you will be facing the following for certain blood alcohol content:

  • BAC of more than .00: This is considered a zero tolerance offense and you will face a three month suspension of all driving privileges. A second offense will warrant a one year suspension.
  • BAC of .05 with evidence of impairment: As a DUI charge, this will result in a revocation of driving privileges for a minimum of two years. A second conviction will result in a revocation for a minimum of five years.
  • BAC of .08 or more: If you are over the legal limit for of age drivers, you will be facing DUI charges. If convicted, you could have your license and any driving privileges revoked for a minimum of two years, with a second offense warranting a minimum five year revocation.

You could also be facing imprisonment for anything above the legal limit, with additional fines. A first offense or second offense will both result in up to $2,500 in fines. If you refuse to take a breath or blood test, you may also have your license suspended and face other penalties.
