Penalties for Resisting Arrest

According to 720 ILCS 5/31-1, a person commits the crime of resisting arrest if they knowingly resist or obstruct the dutiful performance by a peace officer, firefighter, or correctional institution employee of any authorized act within their official capacity. Encompassing any kind of behavior which interferes with official duty, it often involves an individual who refuses peaceful consent of arrest, including running away from the crime scene, striking an office or eluding police while on a car chase. However, even failing to cooperate with law enforcement, such as refusing to put your hands behind your back or getting into the squad, can warrant a resisting arrest charge.

Resisting and obstructing arrest is considered a Class A misdemeanor, which is punishable by a jail sentence of one year and/or a fine of $2,500. However, if a peace officer, firefighter, or correctional institution employee is injured as a result of a person's attempt to resist or obstruct their arrest, it is a Class 4 felony, punishable by a prison sentence between one to three years and/or a fine of up to $25,000.
