New Specialty DUI Court in McHenry County

A new DUI court in McHenry County will focus on specialty driving under the influence cases. The court will handle matters in which a person was charged with multiple DUIs and generally does not have run-ins with the law for other offenses. Individuals whose cases are heard in the specialty court will be given the opportunity to be put on probation instead of facing prison time.

Last year, the 22nd Judicial Circuit received $490,631 to establish a program that helps individuals who may be struggling with alcohol abuse. Officials believe that by focusing on repeat offenders, the criminal justice system can help rehabilitate, as opposed to strictly punishing, individuals who need it. Such measures have been shown to reduce recidivism.

Eligibility Requirements

To qualify for a DUI court program, the individual must:

  • Be 18 years of age or older at the time of the arrest
  • Be facing a felony DUI charge
  • Be a resident of McHenry County
  • Have a substance abuse disorder
  • Not have a lengthy criminal record
  • Not have caused an accident resulting in injury or death

Probation Requirements

To participate in the program, the individual must plead guilty to the DUI charge. The judge will order them to probation, and their sentence will be deferred.

While on probation, they are required to meet specific terms, which can include:

  • Attending treatment
  • Meeting with clinical staff
  • Meeting with a probation officer
  • Taking substance abuse tests
  • Appearing in court every two weeks

After the person successfully completes the terms of their probation, the conviction will not appear on their record. However, if they fail to comply with the orders, they will be required to return to court and be sentenced as if they had never participated in the program.
